Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and DAYDUMP LLC ("DayDump", "we", "us", or "our"), the operator of the DayDump application and related services (the "Services"). By creating an account or using the Services, you agree to these Terms.

1. Your Account

The Services are provided by DAYDUMP LLC. You must be at least 13 years old to use the Services. You must be legally permitted to use the Services in your jurisdiction. Keep your account secure and notify us of any unauthorized use.

2. Acceptable Use

DayDump prohibits content that is illegal or infringing, and in particular:

  • Spam or deceptive content.
  • Harassment, bullying, or stalking.
  • Nudity or sexual content, including sexualized content involving minors.
  • Hate speech or discrimination against protected groups.
  • Violence, threats of violence, or content glorifying violence.

3. Your Content

You retain ownership of your content and grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, and display it as needed to operate the Services.

4. Content Moderation

DayDump reserves the right, but has no obligation, to review reported content and accounts, to remove content or suspend / terminate accounts without prior notice when we reasonably believe they violate these Terms or applicable law, and to preserve records when required by law.

5. Privacy

Our use of your information is described in our Privacy Policy.

6. App Features and Changes

We may add, remove, or modify features and may suspend or terminate the Services at any time.

7. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if required by law.

8. Disclaimers

The Services are provided "as is" without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

9. Limitation of Liability

To the maximum extent permitted by law, DAYDUMP LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages.

10. Arbitration & Class Action Waiver

Except for claims that may be brought in small-claims court, any dispute arising out of or relating to these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and not in a court of general jurisdiction. The arbitration will take place in the state of formation of DAYDUMP LLC, unless otherwise required by law. You and DAYDUMP LLC each waive any right to a jury trial.

YOU AND DAYDUMP LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. You may opt out of this arbitration agreement by emailing contact@daydump.life within 30 days of first accepting these Terms.

11. Governing Law & Venue

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Subject to Section 10, any action not subject to arbitration will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction and venue of those courts.

12. Changes to These Terms

We may update these Terms. If changes are material, we will notify you in-app or by other reasonable means.

Schedule 1 — Apple EULA Addendum

The following applies only when you access the Services on an Apple-branded device, in addition to the foregoing Terms.

  • These Terms are between you and DAYDUMP LLC only, and not with Apple. DAYDUMP LLC, not Apple, is solely responsible for the Services.
  • The license granted for the Services is limited to a non-transferable license to use the Services on any Apple-branded product you own or control, as permitted by the Usage Rules in the Apple Media Services Terms.
  • Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Services.
  • In the event of any failure of the Services to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Services to you. Apple has no other warranty obligation.
  • You and DAYDUMP LLC acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
